The fourth condition' cannot relieve the vendor from proving his title; under it, he is to "prepare and deliver an ahstract of his title" Can he hold out to his purchaser simply an abstract of his own purchase deed of 1849 as the "abstract of his title," when it has been proved that his title actually goes so far back as a Crown grant of 18JJ6? When a man undertakes to sell a fee simple, he undertakes to give a good title. Relying upon the second clause of this fourth condition, the defendant contends in effect that it stops our mouths from asking him to do that very thing which the first clause of the condition expressly binds him to do--i.e., "prepare and deliver an abstract of hi title" Counsel then argued upon the fifth, sixth, and tenth clauses of the conditions, as to delivery of abstract and time within which objections might be taken; cited J Morley v. Cook(b). That case shews that the "delivery of an abstract' means the delivery of a perfect abstract; that is, in conditions referring to time, an abstract as perfect as vendor could furnish at time of delivery--an abstract being, in the stricter sense of the term, "perfect" or complete, when it shows a perfect title. See also the Vice-Chancellor's judgment, at pp. 111-12-15, and see Shurland v. NeifchUd(c). Defendant must furnish an abstract of all documents whatsoever-in his possession affecting the title. It is virtually argued that the vendor rs here entitled by implication to give just whatever title he pleases; but this cannot be, unless he make an express condition to that effect.
